The App provides cruise port information, maps, and navigation assistance. However, we make no warranties or representations about the accuracy, reliability, completeness, or timeliness of this information.
You acknowledge that:
To the fullest extent permitted by applicable law, Apptrekker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the App.
In no event shall Apptrekker's total liability to you for all damages exceed the amount of fifty dollars ($50.00) or the amount you have paid to Apptrekker for the App in the last six months, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
The materials appearing in Cruise Port Compass could include technical, typographical, or photographic errors. Apptrekker does not warrant that any of the materials are accurate, complete, or current.
Apptrekker may make changes to the materials contained in the App at any time without notice. However, Apptrekker does not make any commitment to update the materials.
Apptrekker may revise these Terms at any time without notice. By using the App, you are agreeing to be bound by the then current version of these Terms.
We reserve the right to modify or discontinue the App (or any part or content thereof) without notice at any time and for any reason.
These Terms and your use of the App are governed and construed in accordance with the laws of the jurisdiction in which Apptrekker is located, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the App shall be instituted exclusively in the courts of competent jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
